(Applies only to Purchase Orders or Supplements thereto, regardless of tier, placed with small business firms and/or nonprofit organizations for the performance of experimental, developmental, or research work within the United States).

Patent rights shall be retained under this order as set forth in FAR 52.227-11 (Patent Rights – Retention by the Contractor (short form)), however, the following word changes shall apply:  The word “Contractor” shall mean “Seller”, the word “Contract” shall mean “Purchase Order”, and the words “Contracting Officer” shall mean “Buyer.”

2. CONTROL OF VISITORS

Except with the prior written consent of Buyer, and the cognizant Contracting Officer or his designated representative, Seller shall not permit any visitor to a Seller’s plant, office or facility to view or examine equipment specified to be delivered under this order, or major subassemblies of such equipment, or to obtain information or data concerning such equipment.  As used in this article, “visitor” means any person who visits Seller’s plant, office or facility and who does not represent either Seller, Buyer, or the Government in the performance of this order.  Seller agrees to insert this article including this sentence in all subcontracts covering major subassemblies.

3. FRAUD OR FALSIFICATION

It is agreed that on an annual basis the following paragraph will be provided to all Seller employees performing work under this Order:

 Federal Law (18 US Code 1001) provides as follows;

 “Whoever in any matter within the jurisdiction of any department
 or agency of the United States knowingly and willfully falsifies,
 conceals or covers up by any trick, scheme, or device, or material
 fact; or makes any false, fictitious or fraudulent statements or
 representations, or makes or uses any false writing or document
 knowing the same to contain any false, fictitious or fraudulent
 statement or entry, shall be fined not more than $10,000 or
 imprisoned not more than five years or both.”

In no event will the Seller permit any employee to commence work under this Order prior to receipt of the above paragraph.

4. PRIVACY ACT

FAR Provision 52.224-2 (Privacy Act) applies.  Except as otherwise indicated, the word “Contractor” shall mean “Seller”, the word “Contract” shall mean “Purchase Order” and the words “Government” and “Contracting Officer” shall mean “Buyer.”

5. INTEGRITY OF UNIT PRICES

FAR Provision 52.215-26 (Integrity of Unit Prices) less paragraph (b) applies.  Except as otherwise indicated, the word “Contractor” shall mean “Seller”, the word “Contract” shall mean “Purchase Order” and the words “Government” and “Contracting Officer” shall mean “Buyer”.
